Shoplifting Defense in Hartford
Direct Attorney Access for Hartford Shoplifting Charges
A shoplifting charge calls for a defense built around the specific facts, store encounter, and court procedures involved. At Paetzold Law Group, we represent people accused of shoplifting and other theft-related offenses, including first-time defendants and students concerned about a criminal record’s effect on employment, school, or immigration status.
Our practice focuses exclusively on criminal defense in Connecticut state and federal courts. We bring more than 30 years of combined criminal defense experience to these cases. Clients work directly with the attorney responsible for their defense rather than having their case passed through layers of staff.

How Connecticut Larceny Law Treats Shoplifting
Connecticut doesn’t define shoplifting as a separate offense. Retail theft allegations are prosecuted under Connecticut larceny law, which generally covers wrongfully taking, obtaining, or withholding property with the intent to deprive its owner of that property.
The value assigned to the merchandise can affect the alleged degree of larceny. The exact charge, available defenses, and possible consequences depend on the alleged conduct, the property value, and the statutory classification applied by the prosecution.
Store Detention, Police Contact & the Right to Remain Silent
Connecticut law permits a store owner, employee, or agent to detain a person suspected of shoplifting for a reasonable period. During that time, store personnel may ask for the person’s name and address, summon police, document the encounter, and preserve store records.
A store detention isn’t the same as a police arrest. Once officers arrive and review the allegation, however, they may issue a summons or make an arrest. A misdemeanor larceny summons is legally considered an arrest even if the person isn’t taken into custody or booked at a police station.
You don’t have to answer questions about the allegation beyond providing required identifying information. You may remain silent and request an attorney rather than trying to explain disputed facts during a stressful store or police encounter.
How We Prepare a Shoplifting Defense
We begin by examining how the allegation arose and whether the prosecution can establish an intent to deprive. The circumstances of the encounter guide our strategy rather than a fixed approach.
William H. Paetzold, one of our attorneys, previously served as a Public Defender and worked as a forensic criminalist at the Connecticut State Police Forensic Science Laboratory. His background informs our review of technical and digital records that may be central to a self-checkout or disputed-transaction allegation.
Our preparation may include:
- Reviewing the accusation, witness accounts, surveillance video, receipts, point-of-sale records, and police procedures
- Evaluating the alleged intent and assigned property value
- Negotiating with prosecutors for a reduction or dismissal when supported by the case
- Representing the client during court proceedings and at trial when necessary
- Explaining options and developments throughout the legal process
We prepare each case with the possibility of trial in mind. Our firm has taken more than 60 trials to verdict and argued matters before the Connecticut Appellate Court, Connecticut Supreme Court, and federal court.
Hartford Shoplifting Cases at G.a. 14 Courthouse
Shoplifting cases and other misdemeanor or arraignment matters originating in Hartford are handled at the Geographical Area 14 Courthouse. The Office of the State’s Attorney at G.A. 14 prosecutes misdemeanors, motor vehicle offenses, and certain felonies arising in the Hartford area.
The path a case takes depends on the charge, criminal history, available information, and court process. Accelerated Rehabilitation is a diversionary program that may be available to an eligible first-time or low-risk defendant. If the court grants the program and the defendant completes its requirements, the charge is dismissed and erased.
A prosecutor may instead enter a nolle, meaning the state isn’t pursuing the charge at that time. A nolled larceny case is typically dismissed automatically after 13 months if the state doesn’t reopen it. Eligibility for Accelerated Rehabilitation, a nolle, or another form of dismissal is case-specific. None of these outcomes is automatic at the beginning of a case.
