Connecticut Homicide Charges: What the Prosecution Must Prove
Connecticut doesn’t divide murder into first-degree and second-degree the way most states do. Charges are defined by specific statutory categories, each carrying different elements and penalties.
Murder (C.G.S. § 53a-54a)
The prosecution must prove the defendant intended to cause death and did so. This is a Class A felony carrying 25 to 60 years in prison.
Murder with Special Circumstances (C.G.S. § 53a-54b)
Applies when aggravating factors are present, including killing a law enforcement officer or other specified public safety personnel, a contract killing, a murder committed during kidnapping or sexual assault, or a killing by someone already serving a life sentence, among other enumerated circumstances. Conviction means life without parole.
Felony Murder (C.G.S. § 53a-54c)
A death that occurs during or in furtherance of a specified felony such as robbery, home invasion, burglary, kidnapping, or sexual assault. The defendant doesn’t need to have intended the death to face this charge.
First-Degree Manslaughter
A Class B felony carrying up to 20 years. It may apply when the defendant intended serious injury rather than death, or when extreme emotional disturbance is a factor.
Criminally Negligent Homicide
A Class A misdemeanor, punishable by up to 364 days. Applies when a death results from criminal negligence rather than intentional conduct.
